“Under state law, within 14 days of transfer, you may have the dog, cat, or ferret examined by a licensed veterinarian of your choice. Unless such exam indicates the animal is free of disease, you may obtain a substitution of a similar animal of equal value or, at your option, a full refund of any money exchanged at transfer but only if within 2 business days of such examination you return the diseased animal to the store along with a written statement from the veterinarian that the animal was not free from disease.”
This is a legally binding contract between the SALTY DOGS GOLDENS LLC / CIARFELLA’S RETRIEVERS LLC (Breeder) and Adopter (stated) their heirs, assigns, and successors (Adopter) relating to the adoption of one (1) Golden Retriever puppy (Dog) described herein. The Adopter hereby acknowledges acceptance of Dog and agrees to the following terms and conditions:
- Breeder will provide Adopter with AKC registration application documenting above dog is a purebred Pedigree Golden Retriever. Your puppy is eligible for AKC limited registration (pets only no breeding rights).
- This Dog is found to be of sound health at the time of transfer as per Breeder’s scheduled veterinary visit. BREEDER will provide ADOPTER a completed NH State Health Certificate on said dog upon pick up. We recommend the buyer have this puppy examined by their veterinarian within fourteen business days of receiving said dog, at Adopter’s expense. Puppies do not have fully developed immune systems, and do not receive all their vaccinations until 16-20 weeks of age, during this time please be extra careful to prevent exposing your puppy to possible canine diseases/parasites in remote and public areas.
- This puppy is guaranteed until 2 years of age for a debilitating congenital defect that prevents the puppy from being a companion pet, an exchange of the puppy for a replacement puppy of equivalent value will be arranged when a puppy becomes available. The buyer must notify the seller, within 2 business days, with documentation of the diagnosis by a veterinarian of a health problem and provide the seller with documentation from their veterinarian stating the debilitation and prognosis within 3 days of the date of diagnosis. The seller has the right to get a second opinion from own vet. This guarantee is only applicable to the original Adopter. Said dog is not guaranteed against any disease or disorder, as there are unforeseen illnesses in every creature and such things are unpredictable.
- Dog is being adopted as a companion pet ONLY and is not to be given away, sold, leased, or traded, even as a gift to a friend or family member. Dog will not be abandoned, taken to any pet shop, shelter, research laboratory, or similar facility. If Adopter is no longer able to care for Dog, Adopter must inform Breeder. Breeder is given first option of resuming full ownership of Dog or assisting in re-homing of Dog if necessary. If for any reason, Dog needs to be returned to Breeder, Adopter agrees to safely transport Dog to Breeder
- The Adopter agrees and understands said Dog is not to be bred either intentionally or by accident. Adopter must present proof of altering either by Veterinary receipt or Certificate of Spay/Neuter, within FIVE days of completion of the altering procedure. Any other arrangements will be in writing between the Breeder and the Adopter. If intentional or accidental breeding/litter occurs all puppies and Dog will be the property of Breeder at Breeders discretion. Adopter acknowledges that failure to comply with terms shall be considered a breach of this Agreement which is deemed actionable by Breeder. Breach may mandate the immediate return of Dog to Breeder at Adopter's expense.
- From pick up date forward, Adopter assumes financial responsibility and all costs associated with caring for Dog. Adopter agrees to provide this Dog a life-long commitment and that Dog will be treated in a humane manner, provided with adequate food, water, grooming, shelter, exercise, and health care, as advised by a licensed veterinarian. Health care includes but is not limited to vaccinations, heartworm prevention, flea and tick prevention, as well as prompt emergency care for the duration of the Dog's life.
- Adoption fee is to be paid in full five days in advance of pick up.
- Should Adopter breach any terms in this Agreement, Breeder retains the right to rescind Agreement. If Agreement is rescinded, Dog must be returned to Breeder immediately. Should Adopter fail to return Dog, Breeder may seek an Order from a Court of competent jurisdiction to facilitate the return. Adopter understands and accepts financial responsibility for all attorney and court fees related to this action.
- The Adopter agrees to inform the Breeder if any health concerns arise about the dog. This can provide to the Breeder important feedback and information pertaining to the health of our dogs for future generations. In an effort to uphold the integrity and quality of pets established by the Breeder.
- Adopter acknowledges and accepts this Agreement in the entire Agreement between Adopter and Breeder, and supersedes any prior understandings.
- No modification of this Agreement will be valid unless duly signed in writing by both Adopter and Breeder.
- The invalidity or unenforceability of any provisions of this Agreement shall not affect the validity or enforceability of any other provision of this Agreement, which shall remain in full force and effect. The Agreement shall be construed in accordance with the laws of the State of New Hampshire and /or the State of Maine.
- Breach of agreement excludes Adopter from any refund of the adoption fee.
